Privacy Policy

1. Who we are

Souvenir Photograph ("we," "us," or "our") operates SP Photo Station, a platform for professional photographers to capture, deliver, and sell event and venue photographs to customers. This Privacy Policy describes how we collect, use, and share information about you when you use our services, including the in-venue capture experience, the customer photo gallery, and any text messages we send you.

By using our services or providing your phone number to a participating photographer, you agree to this Privacy Policy. If you do not agree, please do not provide your phone number or use our services.

2. Information we collect

Information you provide directly. When a photographer hands you a phone or device to receive your photo gallery, you enter your mobile phone number and tap a consent checkbox. We collect:

• Your mobile phone number (required to deliver your gallery)
• The fact, date, time, and version of the consent text you agreed to
• The photographer's venue / location at the time of capture

Photographs. The photographer creates photographs of you and uploads them through our platform. We store the photographs so you can view, download, and purchase them via your gallery link.

Information we collect automatically. When you visit your photo gallery or our website, we collect basic technical information (IP address, browser type, page views, timestamps) to operate, secure, and improve the service. We do not use this for advertising or sell it to data brokers.

Payment information. If you purchase prints, digital downloads, or other products, payment is processed by Stripe. We never see or store your full card number — Stripe handles all card data under PCI-DSS Level 1.

3. How we use your information

We use the information we collect to:

• Send you a one-time SMS containing the secure link to your photo gallery
• Display, deliver, and let you purchase the photographs taken of you
• Honor your opt-out requests (STOP, HELP)
• Comply with legal obligations and respond to lawful requests
• Detect, prevent, and respond to fraud, abuse, or technical issues

We do not use your phone number for marketing messages, promotions, or any communications other than the photo gallery link you opted in to receive. We do not sell or rent your personal information to anyone.

4. SMS messaging

Opt-in. You only receive SMS from Souvenir Photograph after you provide your mobile number to a participating photographer and tick the consent checkbox confirming you agree to receive a text message with a link to your photo gallery.

Message content + frequency. You will receive at most one (1) SMS per photo session containing a secure link to your photo gallery. We do not send marketing, promotional, or unsolicited messages. Standard messaging and data rates from your carrier may apply.

Opt-out. You can opt out at any time by replying STOP to any SMS we send you. We will immediately stop sending messages to your number and record the opt-out in our audit trail. To opt back in, reply START to a previous message or contact us at support@spphotostation.com.

Help. Reply HELP to any SMS for assistance, or contact us at support@spphotostation.com.

Provider. SMS delivery is handled by a third-party SMS provider on our behalf, bound by a data processing agreement and prohibited from using subscriber data for its own purposes. The current provider's identity and privacy policy are available on request — contact us at support@spphotostation.com.

5. How we share your information

We share information only with service providers who help us operate the platform, and only to the extent necessary for them to perform their function:

• SMS provider — SMS delivery (your phone number, the text of the message)
• Stripe — payment processing if you purchase products (your billing details)
• Image storage & CDN provider — image storage and content delivery for your photo gallery
• Hosting & database provider — application hosting and database infrastructure
• Email provider — transactional email delivery

Each provider is bound by a data processing agreement and may use your information only to provide services to us. A current list of our sub-processors, including their identities, is available on request — contact us at support@spphotostation.com.

All service providers are contractually bound to protect your information and may use it only to provide services to us. We do not sell, rent, or trade your personal information to third parties for their own marketing purposes.

We may also disclose information when required by law (e.g., subpoena, court order) or to protect the rights, property, or safety of Souvenir Photograph, our customers, or the public.

6. Data retention

Phone numbers + consent records. Retained for as long as you are an active customer plus three (3) years for our audit trail (TCPA compliance). On request, we will delete your phone number from our active records, but we retain the consent and opt-out audit log for the regulatory retention window.

Photographs. Retained for the period set by the participating photographer or venue (typically 90 days to 2 years after the session). After that, photos may be archived or permanently deleted.

Order records. If you purchase products, your order history is retained for seven (7) years for tax and accounting compliance.

7. Your rights

Depending on your jurisdiction, you may have rights to:

• Access, correct, or delete your personal information
• Opt out of SMS messaging (reply STOP to any SMS)
• Object to or restrict certain uses of your information
• Receive a copy of your data in a portable format
• Lodge a complaint with a supervisory authority

California residents. The California Consumer Privacy Act (CCPA) gives you specific rights. We do not sell your personal information. To make a request, email support@spphotostation.com.

8. Children's privacy

Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected information from a child under 13, we will delete it. Photographs of children may be captured at venues where their parent or guardian is present and has consented; in those cases, the parent or guardian provides the phone number and consent on the child's behalf.

9. Security

We use commercially reasonable physical, technical, and administrative safeguards to protect your information, including encryption in transit (TLS), encryption at rest, restricted access controls, and audit logging. No method of transmission or storage is 100% secure, but we maintain practices appropriate to the sensitivity of the information we hold.

10. International users

We are based in the United States. If you access our services from outside the U.S., your information will be transferred to and processed in the U.S. By using our services, you consent to that transfer.

11. Changes to this policy

We may update this Privacy Policy from time to time. The "Effective" date at the top of this page reflects the most recent update. Material changes will be communicated via the platform or via email to active customers.
